Abstract

The period following the break-up of the Soviet Union has brought enormous political and socioeconomic change to the European Region.The health sector has not been spared the effects of transition, and the countries emerging from the process have each engaged to varying degrees in health system reform. It is at last possible to reach some judgement about how this process has unfolded, to identify successes and failures, and to understand better the scale and nature of the remaining challenges. This book draws on the experience and lessons learned in the Region over the past ten years of transition in key health systems areas, such as health care financing, the restructuring of hospitals, public health and gains in health system quality.

Abstract

Face à la situation particulièrement préoccupante des migrants gravement malades, des médecins, avocats, juristes et travailleurs de terrain se sont rassemblés pour publier un livre blanc sur la question des autorisations de séjour pour raisons médicales. Ils l’ont présenté ce jeudi. Prévue par l’article 9 ter de la loi sur le séjour des étrangers, la procédure d’autorisation de séjour pour raisons médicales a été plusieurs fois réformée dans un sens toujours plus restrictif. L’administration n’est pas en reste : son interprétation très étroite de la loi crée de nombreux dysfonctionnements dans le traitement de ces demandes.Le nombre de personnes régularisées pour raisons médicales a fortement diminué ces dernières années. L’écrasante majorité des demandeurs 9 ter, atteints d'une maladie qui peut mettre leurs jours en danger, n'obtiennent pas de titre de séjour et sont renvoyés vers leurs pays d’origine dans lequel ils n'auront pas la possibilité d'être soignés de manière adéquate.Les professionnels de terrain - avocats, juristes, médecins, assistants sociaux - du Nord et du Sud du pays dénoncent depuis longtemps ces pratiques abusives et le surréalisme de la situation. Particulièrement inquiets, ces acteurs ont rédigé un livre blanc, un compte rendu accablant de la situation des migrants gravement malades. Face à des pratiques administratives qui ne respectent pas le prescrit légal, ils ont aussi voulu clarifier les choses. Il n'est plus tolérable que l'Office des étrangers fasse de l'article 9 ter un « permis de mourir » sur le territoire belge, menaçant ainsi directement la dignité et la vie de ces personnes malades.Parmi les dysfonctionnements relevés et analysés : le formalisme excessif dans l’analyse des conditions de recevabilité de la demande 9 ter, l'appréciation trop stricte de la « gravité » de la maladie, l'analyse hâtive de la situation individuelle du demandeur, la motivation insuffisante des décisions de refus, l'examen de la disponibilité générale des soins et non de leur accessibilité effective dans le pays d’origine, etc.Ce livre blanc vise à informer toutes les personnes impliquées dans la prise en charge juridique, sociale et médicale des migrants malades ainsi que les décideurs politiques sur les réalités vécues par des personnes qui comptent parmi les plus vulnérables de notre société.

Abstract
